Terms • Conditions

The work | repairs as specified on the reverse side hereof will be undertaken by creative web design c.c. under the following conditions:

1. All prices quoted on the reverse-side hereof are vat exclusive ex-offices, Pretoria. NB. Creative web design is not a registered vat vendor.

2. The written instructions as described are confirmed by the signing of this document by the client or his authorized representative or agent.

3. The client confirms that no guarantees, expressed or implied were given to him | her, and that no representation of whatsoever nature was made to him | her, except as specified on the reverse-side hereof.

4. Creative web design c.c. accepts no responsibility whatsoever for any loss or damage of any nature whatsoever caused to computer hardware | computer software &|or documentation received in any form [including hard-copy &|or electronic format]. In particular, creative web design c.c. accepts no responsibility for any loss or damage caused due to the negligence of personnel.

5. The parties agree to the jurisdiction of the magistrates court with regard to any dispute arising from the details as specified on the reverse-side hereof.

6. Monthly services are subject to the signing of a debit order. All other payments due | invoices due, will be payable cod (cash on delivery) prior to delivery.

7. Interest calculated at 48% per annum together with storage costs calculated at r10.00 per day will become payable on all outstanding accounts after the expiry date as permitted in paragraph 6.

8. The client hereby authorizes creative web design c.c. irrevocably and in rem suam to sell the goods as mentioned on the reverse-side [applicable to computer hardware and | or software] hereof to defray expenses should the client fail to pay the balance outstanding within the period as permitted in paragraph 6 after having received an invoice | request for payment.

9. Creative web design c.c. will be obliged to deliver the goods as specified on the reverse-side hereof only on presentation of a copy of proof of payment [applicable to electronic transfers | direct bank deposits] of the agreed price as specified on the invoice | request for payment.

10. In signing the reverse-side hereof the client commits him | herself irrevocably to the terms and conditions thereof. Should the client cancel this “contract | terms and conditions | this document” for whatsoever reason, creative web design c.c. will be entitled to recover from the client any loss or damage including loss of the cancellation of the reverse-side hereof in this regard the parties agree that creative web design c.c. will be entitled if so preferred to prove the actual loss suffered and to recover this from the client.

11. A deposit of 50% is required prior to commencing of any and | or all computer related services whereas full payment is required on new orders [purchases] as agreed upon.

12. This document contains the full terms and conditions of the services as specified on the reverse-side hereof between the parties and no other terms or conditions expressed or implied will apply to this agreement. Any alteration of the terms and conditions being in respect of the reverse-side hereof shall be in writing and signed by all the parties hereto.
